Terms of Use

The short version. By using NestQuestSA you agree to use it honestly, not to scrape or abuse the Service, and to understand that we don't guarantee the accuracy of every property listing — that's the listing agent's responsibility.
Beta notice. This is a v1.0 working terms document that reflects how we currently operate. It will be reviewed by a South African attorney before our commercial launch.

1. Who these terms apply to

These terms apply to anyone who uses NestQuestSA (the "Service"), whether as a buyer, renter, agent, or casual visitor. By using the Service you agree to these terms. If you don't agree, please stop using the Service.

2. Acceptable use

You agree that you will not:

  • Use the Service to harass, defraud, or impersonate anyone.
  • Scrape, crawl or bulk-download content from the Service without our prior written permission.
  • Submit fake listings, fake testimonials, or false agent credentials.
  • Attempt to bypass security, rate limits, or access controls.
  • Use the Service in any way that violates South African law.

3. Listing accuracy

Listings on NestQuestSA are submitted and maintained by the listing agent. While we verify agents and require them to confirm the accuracy of their listings, we do not independently inspect every property. We are not responsible for inaccuracies in listing details — you should always confirm key facts (price, size, fixtures, condition) directly with the listing agent and on a physical viewing before making any offer.

4. No estate-agent relationship

NestQuestSA is a property portal, not an estate agency. We don't represent buyers or sellers in any transaction. Your relationship is with the agent or seller you engage through the Service.

5. Agent obligations

If you use the Service as a real estate agent or agency, you agree to:

  • Hold a valid Fidelity Fund Certificate from the Property Practitioners Regulatory Authority (PPRA).
  • Only list properties you have a current mandate to market.
  • Respond to genuine buyer and tenant enquiries within a reasonable time.
  • Update or remove listings within 48 hours of them becoming sold, rented, or withdrawn.

6. Content ownership

Photos, descriptions and floorplans you upload remain yours, but you grant NestQuestSA a non-exclusive licence to host, display and distribute them as part of the Service. You confirm you have the right to upload everything you upload.

7. Limitation of liability

The Service is provided "as is". To the fullest extent permitted by South African law, NestQuestSA is not liable for any indirect, incidental, special or consequential losses arising from your use of the Service.

8. Suspension and termination

We may suspend or terminate your access to the Service if you breach these terms or applicable law. You can stop using and delete your account at any time.

9. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be heard by the appropriate South African courts.

10. Changes to these terms

If we materially change these terms, we will email registered users and update the version number and date above before the change takes effect.
